1. Service Description
Fax From Phone ("the App") is a mobile application that allows you to send faxes directly from your phone. You can scan documents using your camera or upload existing files, then transmit them to any fax number. The App is developed and operated by Fahad Rashid ("we," "us," or "our").
By downloading, installing, or using the App, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.
2. License Grant
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on any Apple-branded products that you own or control, and as permitted by the Apple Media Services Terms and Conditions ("Usage Rules").
You may not:
- Copy, modify, or distribute the App or any part of it
- Reverse engineer, decompile, or disassemble the App
- Rent, lease, lend, sell, or sublicense the App
- Use the App for any purpose other than sending faxes as intended
3. Account Registration
- You must create an account to use the App's fax services.
- You must provide a valid email address and create a secure password.
- You must be at least 13 years old to create an account (or 16 in jurisdictions where the age of digital consent is higher).
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activities that occur under your account.
- You agree to provide accurate and complete information and to update it as needed.
4. Subscriptions and Auto-Renewal
The App offers subscription plans that provide access to fax sending features:
- Weekly Plan — billed weekly, includes fax pages as displayed on the subscription screen within the App.
- Monthly Plan — billed monthly, includes fax pages as displayed on the subscription screen within the App.
Exact pricing and page allocations for each plan are displayed on the subscription screen within the App prior to purchase. By subscribing, you confirm that you have reviewed and agree to the pricing and features shown at the time of purchase.
Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.
You can manage or cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period.
Prices are in USD and may vary by region. We reserve the right to change subscription pricing with advance notice.
5. Page Pack Purchases
In addition to subscriptions, you may purchase page packs — bundles of fax pages that do not expire.
Non-Refundable: All page pack purchases are final and non-refundable. Pages do not expire and remain in your account until used. Unused pages are not transferable.
6. Acceptable Use
You agree to use the App only for lawful purposes. You must not:
- Send spam faxes — unsolicited bulk faxes or junk faxes are strictly prohibited
- Send illegal content — faxes containing illegal, threatening, defamatory, obscene, or otherwise objectionable content
- Violate the Telephone Consumer Protection Act (TCPA) — or any other applicable telecom laws and regulations
- Impersonate others — misrepresent your identity or affiliation when sending faxes
- Transmit malware — send content designed to harm recipients' fax machines or systems
- Abuse the service — attempt to circumvent usage limits, exploit bugs, or disrupt the service
We reserve the right to suspend or terminate your account if you violate these terms, without refund.
7. Fax Delivery
No Guarantee of Delivery: While we strive for reliable fax transmission, we cannot guarantee that every fax will be successfully delivered. Delivery depends on factors beyond our control, including the recipient's fax machine status, phone line quality, and network conditions.
We are not liable for any damages, losses, or consequences arising from failed, delayed, or incomplete fax deliveries. It is your responsibility to confirm receipt of important faxes with the intended recipient.
Pages used for failed fax attempts may be refunded to your balance at our discretion.
8. Intellectual Property
The App, including its design, code, features, graphics, and content, is the intellectual property of Fahad Rashid and is protected by copyright and other intellectual property laws.
You retain ownership of any documents you upload or scan through the App. By using the App, you grant us a limited license to process, store, and transmit your documents solely for the purpose of providing the fax service.
9. Limitation of Liability
To the maximum extent permitted by applicable law:
- The App is provided "as is" and "as available" without warranties of any kind, whether express or implied.
- We disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement.
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
- Our total liability for any claim arising from your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless Fahad Rashid from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the App, violation of these Terms, or infringement of any third-party rights.
11. Termination
- You may delete your account at any time through the App or by contacting us.
- We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion.
- Upon termination, your right to use the App ceases immediately. Any unused page balance or remaining subscription time is forfeited upon termination for cause.
- Provisions that by their nature should survive termination (such as limitation of liability and indemnification) will survive.
12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, United States of America, without regard to its conflict of law provisions.
Before filing any formal legal action, you agree to first contact us and attempt to resolve the dispute informally for at least 30 days. If the dispute is not resolved informally, any disputes arising under these Terms shall be resolved in the state or federal courts located in Illinois, and you consent to the jurisdiction of such courts.
13. Apple App Store Terms
The following terms apply to users who download the App from the Apple App Store:
- These Terms are between you and Fahad Rashid only, and not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content.
- Apple has no obligation to provide any maintenance or support services for the App.
- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
- Apple is not responsible for addressing any claims by you or any third party relating to the App, including product liability claims, consumer protection claims, intellectual property claims, or any claim that the App fails to conform to any applicable legal or regulatory requirement.
- In the event of any third-party claim that the App or your possession and use of it infringes that third party's intellectual property rights, Apple is not responsible for the investigation, defense, settlement, or discharge of any such claim.
- Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
14. Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting updated Terms within the App and updating the "Effective Date" above. Your continued use of the App after changes constitutes acceptance of the updated Terms.
